New Executive Order regarding Pay Transparency
Executive Order 13665 requires new protections that need to be incorporated into your EEO Statement:
We will not discharge or in any other manner discriminate against any employee or applicant for employment because such employee or applicant has inquired about, discussed, or disclosed the compensation of the employee or applicant or another employee or applicant.
Under the “motivating factor” standard, a complainant need only demonstrate that discussing or disclosing compensation information was one of any number of factors in the employer’s discharge or discipline decision, even if it was not the only determining factor.
The moral of this new Executive Order: Let them discuss their pay, as long as they want to.
